Terms of Service

1. Acceptance of Terms

By accessing or using Sensible ("Service"), including our Chrome extension and web dashboard, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Sensible is a parental monitoring service that allows parents or legal guardians to:

• Monitor their children's conversations with AI assistants (such as Claude, ChatGPT, Gemini, and Character.AI)
• Receive alerts about potentially concerning content
• Manage devices linked to their children's profiles

The Service consists of:

• A Chrome browser extension installed on the child's device
• A web dashboard for parents to view conversations and manage settings

3. Eligibility

3.1 Parents/Guardians

To create a Sensible account, you must:

• Be at least 18 years of age
• Be the parent or legal guardian of any child you monitor
• Have legal authority to consent to monitoring on your child's behalf

3.2 Monitored Children

Sensible is designed to monitor children ages 10-17. By using the Service, you represent that:

• You are the parent or legal guardian of the monitored child
• You have the legal right to monitor your child's online activities
• You will inform your child that monitoring is taking place

4. Account Registration

4.1 Account Creation

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials.

4.2 Account Security

You are responsible for all activity under your account. Notify us immediately at hello@getsensible.app if you suspect unauthorized access.

5. Acceptable Use

5.1 You Agree To:

• Use the Service only to monitor your own minor children
• Comply with all applicable laws regarding parental monitoring
• Keep your account credentials secure
• Provide accurate information about yourself and your children

5.2 You Agree NOT To:

• Monitor anyone other than your own minor children
• Use the Service for any illegal purpose
• Attempt to circumvent security measures
• Reverse engineer, decompile, or disassemble the Service
• Share your account with others
• Use the Service to harass, stalk, or harm any person
• Resell or redistribute the Service

5.3 Prohibited Monitoring

You may NOT use Sensible to:

• Monitor adults (18+) without their explicit consent
• Monitor children who are not your legal dependents
• Monitor employees, partners, or other non-dependent individuals
• Conduct surveillance for commercial or legal proceedings

6. Child Notification

6.1 Requirement

You agree to inform your child that their AI conversations are being monitored. The Chrome extension displays an indicator when active.

6.2 Recommended Approach

We recommend having an open conversation with your child about:

• Why you are monitoring their AI conversations
• What types of content may trigger alerts
• How this monitoring is intended to keep them safe

7. Subscription and Payments

7.1 Free Tier

Sensible may offer a free tier with limited features. Free tier availability and limitations may change at any time.

7.2 Paid Subscriptions

Paid subscriptions, if offered, will be billed according to the plan selected. Subscription terms, pricing, and features will be displayed at the time of purchase.

7.3 Cancellation

You may cancel your subscription at any time through the dashboard. Cancellation takes effect at the end of the current billing period.

7.4 Refunds

Refunds are provided at our discretion. Contact hello@getsensible.app for refund requests.

8. Intellectual Property

8.1 Our Property

Sensible, including all software, designs, text, and graphics, is owned by Sensible and protected by intellectual property laws. You receive a limited, non-exclusive license to use the Service for its intended purpose.

8.2 Your Content

You retain ownership of any content you provide (such as child profile names). By using the Service, you grant us a license to store and process this content solely to provide the Service.

8.3 Feedback

Any feedback, suggestions, or ideas you provide may be used by us without obligation to you.

9. Third-Party Services

9.1 AI Platforms

Sensible monitors conversations on third-party AI platforms (such as Claude, ChatGPT, Gemini, and Character.AI). We are not affiliated with these platforms. Your use of those platforms is subject to their respective terms of service.

9.2 Integration Limitations

We cannot guarantee uninterrupted monitoring. AI platforms may change their interfaces, which could temporarily affect the Service.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimers

11.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 No Guarantee of Safety

Sensible is a tool to assist parental oversight. We do NOT guarantee:

• Detection of all harmful content
• Prevention of any specific harm to your child
• 100% accuracy of safety classifications
• Uninterrupted service availability

11.3 Parental Responsibility

You remain fully responsible for your child's safety and wellbeing. Sensible is a supplement to, not a replacement for, active parenting.

12. Limitation of Liability

12.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENSIBLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL; SERVICE INTERRUPTION; COMPUTER DAMAGE OR SYSTEM FAILURE; OR ANY HARM TO YOUR CHILD THAT THE SERVICE FAILED TO DETECT OR PREVENT.

12.2 Maximum Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold harmless Sensible, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, or your monitoring activities.

14. Termination

14.1 By You

You may terminate your account at any time by deleting it through the dashboard or contacting us.

14.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Use the Service for prohibited purposes
• Fail to pay applicable fees

14.3 Effect of Termination

Upon termination:

• Your access to the Service will cease
• Your data will be deleted according to our Privacy Policy
• Provisions that should survive termination will remain in effect

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of Delaware, United States, without regard to conflict of law principles.

15.2 Informal Resolution

Before filing any legal claim, you agree to contact us at hello@getsensible.app and attempt to resolve the dispute informally for at least 30 days.

15.3 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15.4 Class Action Waiver

YOU AGREE THAT ANY CLAIMS WILL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

16. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or dashboard notice at least 30 days before taking effect. Continued use after changes constitutes acceptance.

17. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Sensible regarding the Service.
• Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
• Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: You may not assign your rights under these Terms. We may assign our rights to any successor or affiliate.
